New Jersey Background Checks Legislation At Final Hurdle

The NJ Governor is going to sign this bill unless he gets email from affected constituents, e.g. on line daters and dating and social networking industry doing business in New Jersey, asking for a veto SB 1977. You are our last and best hope for a veto. It is the 11th Hour in NJ. Governor John Corizon can at any moment sign, and has until Jan. 15th at noon to sign, the first online dating bill in the 50 states. The very powerful Senate Leader Cody included SB 1977 in a trio of bills trumpeted as increasing online safety. We at the Internet Alliance believe offering criminal background checks for online daters provides a false sense of security. We also think online dating is an activity and an industry that does not need to be regulated. Finally, we think the bill as written is unconstitutional. We are afraid when this bill passes in New Jersey it will open the floodgates for regulation of dating and social network sites. Click here for email address and more info.

Mark Brooks: The NJ State Assembly passed bill number A4304 which corresponds with NJ State Senate bill S1977, known as the Internet Dating Safety Act, which is aimed at Online Dating businesses.  The controversial part of this bill is section 4.b. which reads… "If an Internet dating service does not conduct criminal background screenings on its members, the service shall disclose, clearly and conspicuously, to all New Jersey members that the Internet dating service does not conduct criminal background screenings. The disclosure shall be provided when an electronic mail message is sent or received by a New Jersey member, on the profile describing a member to a New Jersey member, and on the web-site pages of the Internet dating service used when a New Jersey member signs up. A disclosure under this subsection shall be in bold, capital letters in at least 12-point type."

Veto SB 1977

New Jersey residents may email veto requests to Fruqan Mouzon, the Counsel to the Governor.  His email address is Fruqan.mouzon@gov.state.nj.us .
It is sufficient and powerful for a New Jersey voter to send an email just saying: "Please veto SB 1977 because __________."

The following are two examples of what people might send if they want to be more elaborate.

FROM AN ONLINE DATER:

"I urge you to veto SB 1977 as it suggests that online dating services are somehow more dangerous than traditional dating methods.

I would like to point out the many perks of online dating that the offline dating scene simply cannot offer. The benefits of online dating are absolutely endless. Individuals or groups of people who want to meet other people for social purposes, romantic attachments, or just to make new friends can do so through the means of online dating services.

First, conversing online is much safer than meeting someone in a bar as:

    * I have the opportunity to get to know someone from the comfort of my own home without having to reveal what I look like or even my name.
    * I choose when it is appropriate for the person to know my name or what I look like.
    * I can easily end a conversation with someone by simply blocking them from my email.
    * I can evaluate someone based on similar interests and character traits that I feel are important to me before I decide I want to meet the person face to face.
    * Once I choose to meet someone face to face, I conduct my own background check. I would never rely on a dating site to decide who I do or do not want to date.  I can easily hire an inexpensive private service that will search a person’s background based on my own criteria. For example, I would care less about a potential mate that has been convicted of a felony DWI than I would convicted of a sexual offense.

SB 1977 sends the wrong message to daters.  It suggests that background checks are accurate and comprehensive.

Even as a novice dater, I know that someone could easily provide me with a fake name so they would not show up on a background check.  That is why I also ask other daters, family and friends about the person before arranging a face to face meeting, which I usually do in a public place."

AND FROM A BUSINESS

"Please veto New Jersey SB 1977, the online dating background check bill as the bill is unnecessary and could actually make the Internet less safe for consumers pursuing relationships online. 

The bill is:

*       Misleading. Will mislead and confuse users of online services as the bill suggests to consumers that background checks are accurate and comprehensive. Background checks are flawed as identifying data can be easily falsified by someone who wants to subvert the system. Consumers should not be led to believe that background checks make them safer.

  *   Ineffective. State-level regulation of an inherently interstate service does not work. Subscribers routinely communicate and develop relationships -cross state lines, making it nearly impossible for dating services to comply with a patchwork of different state laws. In fact, the Internet as a dating medium actually makes for a safer online experience, since members can interact via computer to determine when and whether it is safe to meet in person.

*   Costly.  The increased cost of companies having to background checks on members could be passed on to consumers who would end up being forced to purchase background check services they may not want or need. The bill would also likely increase costs to New Jersey taxpayers by triggering a successful constitutional challenge on Dormant Commerce Clause and First Amendment grounds.

*       Unnecessary. Leading online dating services already provide safety warnings in terms of service and on company websites.  SB 1977 would require onerous notice requirements that would be ineffective and highly burdensome to any business.  Requiring companies to conduct criminal background searches on all users or post scary warning notices prominently on the homepage of websites would drive users away.

*        Discriminatory. The legislation discriminates against Internet business by applying only to dating services that operate primarily online. There is no justification for this discrimination, especially because there are many more offline dating services than their online counterparts.

The marketplace is the best place to address these issues. Consumers are in the best position to determine which services provide them with the most security and comfort. An informed consumer, armed with technology, common sense and information is the best protection they can have when doing anything online.

Similar bills have been considered in several states and failed over the past four years.  Those states are: California, Florida, Illinois, Michigan, Ohio, Virginia, Alaska and Texas.

Again, SB 1977 is fundamentally flawed and unconstitutional, please veto the bill."

From 10 Hours a Week, $10 Million a Year

MarkusfrindNY TIMES — Jan 13 — Markus Frind, a 29-year-old Web entrepreneur, developed software for his dating site, PlentyofFish, that operates almost completely on autopilot, leaving Mr. Frind plenty of free time. On average, he puts in about a 10-hour workweek. Mr. Frind operates the business out of his apartment in Vancouver, British Columbia, and has net profits of about $10 million a year. According to comScore Media Metrix for November 2007, PlentyofFish had 1.4 million unique visitors in the United States. In December, the site served up 1.2 billion page views. PlentyofFish does not need a support structure to handle members' subscription and billing issues because the service is entirely advertising-based. Its tagline is: "100 percent free. Put away your credit card." Its success demonstrates that many consumers will tolerate, and even embrace, advertising when a site offers a free service for which others charge membership fees. Stephen_stokolsOPW INTERVIEW — Jan 13 — WooMe is bottling speed dating. (So is Speeddate.com.) Here’s  OnlinePersonalsWatch interview with the CEO. – Mark Brooks

What is WooMe?
It’s an introduction platform that allows people to meet in fast-topic speed sessions via voice and video. Users create their own sessions on any subject that is of interest to them. An example might be Nature Lovers in San Francisco. Each session melds 5 men and 5 women and each topic draws different personalities. Users enter the session and talk with each person of the opposite sex for 1 or 2 minutes (depending on what the session leader specified) and then are automatically transferred to the next person in the group. For now, WooMe is online speed dating platform, but we see many other applications in the future.

Tell me a little bit about your founding story.
My little sister and her friends were talking about how lame traditional dating sites are. It takes too long; they don’t like the stigma associated with it; and they thought all profiles sound the same. My little sister had actually been to a speed dating event last Christmas and she was telling me how fun it was and wouldn’t it be great if it could move online.

At the same time I was at British Telecom as VP in charge of new wave revenues. I had been looking at browser voice and video and trying to think of new applications. When she told me about speed dating, the light went off.

Who is your target audience?
Actually, it’s deliberately the younger, more casual setting. Our tag line is Enjoy the Minute. Our audience wants a more fun, less intense meeting experience. We consider ourselves an introduction platform on which dating is the core application, though many sessions are not about dating at all. Before Thanksgiving, we had a few sessions for people trying to find travel partners. We want to keep it very open-ended and a bit lighter. It doesn’t have the pressure of having to find your soul mate. Instead, its fun and allows people to connect in the way you would connect in person, without all the pressure. I think this has more appeal to the younger demo, who are as interested in meeting new people as anybody, but are turned off by the hardcore dating sites.

Do you find that when most people set up sessions that are geographically based?
Actually, only about 25% of the sessions are regional. The other 75% are interest-based only. There are a lot of people just looking to have a good time and they’re not as concerned about geography. We have built geographic specification into the product and we expect it to get a bit more regional as times goes by.

Why do you think online speed dating is better then offline speed dating?
First of all, there’s sort of a self selection. If you go to an offline speed dating event you don’t know who is going to be there. A typical session might be Catholic singles Los Angeles Age 34-46. It’s very broad. We are much more granular. We have had sessions called People Who Hate Bush and People Who Love Film. Each session is very different. It’s a far deeper level of segmentation. In addition, WooMe is quicker. You can log on whenever you want. And it’s free. You can also meet people from anywhere. For example, I might want to meet people in Europe or in Brazil. You have all kinds of different options when you webify something the way we have.

What makes you better then some of the other speed dating sites?
The biggest one out there is Speed Date, I think. They have a different model. In their model, the user enters and gets put into a blind session with somebody for 3 minutes. Then, they get switched to someone else that they might not have anything in common with. What we’ve done is a much more sophisticated platform. Our interactions are session based by interests, so it gives users greater ability to self-select. Users can create their own sessions with their own interests and invite people to their sessions. Plus, we have much more traffic. Come to the site at prime time and you’ll see 10 or 15 sessions all starting within the next 20 minutes.

How do you plan to monetize this?
After I interact with someone I have the ability to Woo her. If she Woo’d me as well, the system sends a message that says, Congratulations Steven, Annie 21 was also Wooed by you. At that point it’s $1 to get her contact information. So I pay a buck, get her email address and I can take it further myself. If she pays the $1, she gets mine as well. Right now we’re giving people unlimited Woo credit, so it’s currently free.

How do you prevent abuse by users?
We’ve got two functionalities. If someone is being abusive to you in a session, you block them and they can no longer interact with you or see your profile. Or users can report someone. If someone gets reported 3 times, we kick that person off the site.

You’re still in Beta right now. When are you planning on going live?
We’re open, but we’re officially in Beta because we are adding new functionality every couple of days. We’ll probably be in Beta for another 3 to 4 months. Whereas a month ago, we had just opened and we were adding about 200 people a day. Today, we are adding thousands of new users each day. We’re still learning from our users what we need to tweak and what functionality we need to add.

Mark Brooks: Singles have specific needs for their date venues. It's great for them to have a recommended shortlist. Other sites such as Manhunt and Date.com offer targeted local advertising to venues. We'll see more sites offering targeted advertising and building out there content sections in 2008. Internet dating sites need to distinguish themselves as much as possible from social networks. Adding highly magazines, and user generated content useful to singles is a good move. Gates Says Goodbye

MARKETWATCH — Jan 7 — Gates delivered the keynote for CES for the last eight years. He used the speech to outline his vision for the future of consumer technology, noting that advances in areas such as connectivity, user interface and high-definition video and audio will be the main driving forces for the sector in the next 10 years. "The first digital decade has been a great success", he said of the past 10 years. "The second digital decade will be more focused on connecting people.  It will be more user-centric."
